These Terms and Conditions ("Agreement") govern the use of the Nirkum app and the associated services provided by Nirkum Entertainment Private Limited ("we," "us," "our"). By accessing or using the Nirkum app (the "App") or any related services (the "Services"), you agree to comply with and be bound by the following Terms and Conditions. If you do not agree to these terms, you may not access or use the App or Services.

1. Acceptance of Terms

If you are using the App or Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to this Agreement.

2. Account Creation

To access certain features of the App, including uploading files, streaming video/audio, and utilizing other interactive elements, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and are liable for all activities that occur under your account.

3. User Content and Uploads

You may upload, stream, or otherwise share content (including video and audio files) on the App. By uploading any content, you represent and warrant that:

  • You have all necessary rights, licenses, and permissions to upload, stream, or share the content.
  • The content you upload does not violate any intellectual property rights, privacy rights, or other legal rights of any third party.
  • You grant Nirkum Entertainment Private Limited a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as necessary for the operation of the App.

You understand and acknowledge that Nirkum Entertainment Private Limited may, at its sole discretion, remove or disable access to any content that violates these Terms or is deemed inappropriate.

4. Use of Services

You agree to use the App and Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Upload, stream, or share any content that is illegal, defamatory, abusive, offensive, or infringes the intellectual property rights of others.
  • Engage in any conduct that could damage, disable, overburden, or impair the App or Services.
  • Attempt to gain unauthorized access to the App, accounts, computer systems, or networks.

5. Intellectual Property

All content, features, and functionality available on the App, including but not limited to text, graphics, logos, images, videos, and software, are the property of Nirkum Entertainment Private Limited or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content without the express written permission of the owner.

7. Limitation of Liability

Our total liability for any claims, losses, or damages shall not exceed the amount paid by you, if any, for the use of the App or Services in the six months preceding the claim.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India Gujarat. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad.

We reserve the right to modify or update these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the App or Website. Your continued use of the App or Services after the posting of any changes constitutes your acceptance of those changes.
